SCOTUS Brief: Media Continue to Swing and Miss At Kavanaugh

Here’s the news you need to know on this Monday, August 20, 2018.

Media’s biggest Kavanaugh misses: Aspiring hit pieces on Supreme Court pick draw mockery
Yet a string of would-be media hits on President Trump’s Supreme Court nominee, Brett Kavanaugh, have fizzled on impact — doing little to dent his image and, in some cases, backfiring on the news outlets that published them. This includes articles ‘exposing’ how he spent big bucks on baseball games and, most recently, a detailed New Yorker analysis of his college sports reporting three decades ago — which quotes one academic, somehow, asserting that Kavanaugh’s college basketball articles show he would endorse “unlimited Presidential power” under Trump.

Democrats demand documents to distract and delay
Now Democrats are claiming they need to see literally millions of pages of documents from Kavanaugh’s years working in the Bush White House.  Their request is so overbroad, it even includes documents Kavanaugh himself never touched but in which his name was mentioned. You can’t make this stuff up.

Upon Further Review:  Even Kavanaugh’s Dissents Often Prevail
He also notched a successful record on further review. Of those 29 opinions identified by the Congressional Research Service, the Supreme Court ended up hearing eight appeals of the same or similar cases. Judge Kavanaugh’s reasoning prevailed substantially in six of those cases.

A vote on SCOTUS could dash Senator McCaskill’s re-election dreams
Ms. McCaskill is one of 10 senators set to vote on the nomination who are seeking re-election in states won by Mr. Trump in 2016. A vote for Judge Kavanaugh could show Republican voters that they are willing to work with the president. But the activated Democratic base is pushing senators to reject him, worried it will solidify the court’s conservative majority.
